Cope, a 5-4 majority of the Supreme Court of Canada said sentencing judges must consider the circumstances of both an Indigenous offender and an Indigenous partner who was harmed, using a three-step approach. The Court dismissed the Crown’s appeal, so the three-year sentence set by the Nova Scotia Court of Appeal stays in place.
